Proposed changes to the solid waste regulations regarding composting

The Solid Waste and Materials Management Program of the Colorado Department of Public Health and Environment is proposing changes to "Section 14 - Composting" of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 Part 1.

These changes will address some of the permitting issues identified in the Organics Management Plan. Specifically, they will:

  • Increase the volume of Type 2 material that Conditionally Exempt Small Quantity Composting Operations can manage, and;

  • Create a class of facility between Conditionally Exempt and Class III that is able to accept source separated organics and food residuals.

The draft regulations are available on the solid waste proposed rulemakings and stakeholder processes webpage. We will be hosting a virtual stakeholder meeting on Monday, September 25 from 1:00-2:30 p.m. to discuss the proposed changes and gather stakeholder input. Prior to the meeting, we will share additional materials regarding the proposed changes.

In addition, stakeholders may submit comments on the proposed changes to [email protected] until October 31, 2023. If necessary, we will schedule a second stakeholder meeting to gather additional feedback.

We will present an overview of the proposed changes to the Solid and Hazardous Waste Commission during the November 21, 2023 commission meeting. A formal rulemaking hearing will take place in February 2024. Please visit the Solid and Hazardous Waste Commission webpage for additional information.
